Privacy First: Your family’s information remains private and secure. We never sell or share your data for outside marketing. The stories, characters, and images you create together are fully owned by you, and any personal data is used only to make Wundr AI better for you and your family.

Parental Control and Kid-Friendly Features: Wundr AI is designed for parents, guardians, with children to explore and create stories together. Parents and guardians stay in control, ensuring a safe, engaging experience that nurtures children’s creativity, learning, and sense of wonder.

Content Safety: Our AI tools work alongside you to create fun, educational, and age-appropriate content. With built-in moderation, we take special care to ensure all content aligns with our commitment to family-friendly standards and child safety.

Clear Data Ownership: We respect your creative ownership. Any stories, characters, or images you and your family create are yours to keep. Wundr AI retains the right to use this content solely for promotional purposes to help improve and grow Wundr AI.

Transparent Data Practices: We’re open about how we handle your data. If you choose to delete your account, we follow strict data retention and deletion policies to remove your personal information securely.
A Secure Environment: We use the latest security measures to keep Wundr AI a protected space. You and your family can focus on creating, learning, and enjoying stories without worry.

Definitions

“App” or “Application”: Refers to the Wundr AI mobile application and any related software, content, features, or services provided by Wundr AI, Inc.

“Content”: Any text, images, audio, characters, stories, or other media generated by the App or uploaded by the User.

“User” or “You”: Any person who accesses or uses the App, including parents, guardians, and minors who may use the App under adult supervision.

“Virtual Currency”: Credits or other forms of in-app currency that can be purchased and used within the App for certain features or content.

“Subscription”: A recurring paid plan for accessing premium features of the App as outlined in the in-app purchase options.

“Owner,” “Company,” “We,” “Us,” "Wundr", or “Wundr AI”: Wundr AI, Inc., the legal entity that owns and operates the App.

“Third-Party Services”: Services or content provided by external parties that are integrated into the App, such as payment processors, AI services (e.g., OpenAI), and app stores (e.g., Apple App Store, Google Play Store).

1. General Use, Target Audience, and Parental Control

The App is designed for parents and guardians who can create, customize, and supervise the use of the App for children. The primary users of this App are adults (parents or guardians) who may allow their children to access and use the App under their direct supervision.

Parental Supervision Requirement: Minors under the age of 13 may access and use the App only under the supervision of a parent or guardian. Users over the age of 13 may use the App independently, but they must adhere to these Terms.

Age Restrictions: Users of the App must be at least 13 years old. Parents or guardians must approve and oversee any interaction with the App by children under 13.

Responsibility for Supervised Use: Parents or guardians are responsible for monitoring and supervising their children’s activity within the App and ensuring compliance with these Terms.

Parental Consent and Age Verification for Non-U.S. Users: If you are accessing Wundr AI from outside the United States, children under the age of 13 may only use the App under the direct supervision of a parent or guardian, who must provide verifiable consent. By registering for the App, you confirm that you meet the minimum age requirement applicable in your location or have obtained the necessary parental consent if required. Parents and guardians are responsible for supervising their children’s use of the App. Wundr AI does not independently verify the age of users outside the U.S. By using the App, parents and guardians agree to monitor use and ensure compliance with all applicable age requirements.

2. Account Registration and Security

To use the App, you may need to create an account and provide accurate, current, and complete information as required. You are responsible for safeguarding your login credentials and all activities under your account.

Account Conditions: You agree not to use bots or automated methods to create accounts and may only register one account unless otherwise permitted by us.

Account Termination: You may terminate your account at any time by following the instructions in the App or contacting hello@wundr.ai. We reserve the right to suspend or delete accounts that violate these Terms or appear fraudulent, offensive, or inappropriate.

License Termination for Violations: Any violation of these Terms, including misuse of the App or prohibited content uploads, may result in the immediate termination of your license to use the App and access its features. Wundr AI reserves the right to remove access without notice in such cases.

3. Content Ownership and Usage

Ownership of AI-Generated Content

As a user of Wundr AI, you retain full ownership of any stories, characters, images, and other outputs generated through the App. This ownership grants you personal rights to use, retain, and privately share or adapt your content as desired.

Exclusive Marketing and Licensing Rights for Wundr AI

While you own the content generated through Wundr AI, you grant Wundr AI an exclusive, royalty-free, irrevocable, and worldwide license to market, display, distribute, and use your content in connection with the App’s promotional activities, marketing campaigns, and commercial endeavors. This exclusive right allows Wundr AI to feature select user-generated content in promotional materials, public showcases, or any media designed to promote Wundr AI or related services.

User Rights and Restrictions

Non-Commercial Use for Users: While you retain ownership of the content, it is granted for personal, non-commercial use unless otherwise agreed in writing.

Retention and Downloading: You may retain copies of your generated content within the App, and, where enabled, may download this content for offline personal use. This downloaded content remains subject to Wundr AI’s exclusive marketing rights.

Ownership and Licensing of User-Uploaded Content

If you upload additional content, such as personal photos or text, you retain ownership of this content. By sharing it within the App, you grant Wundr AI a non-exclusive, royalty-free license to process, display, and use your content solely for the purposes of operating and improving the App.

Content Moderation

Wundr AI reserves the right to review, moderate, or remove any user-uploaded content that violates these Terms or is deemed inappropriate. Such removal may occur without prior notice, and Wundr AI has no liability for content that is removed or moderated.

4. Camera Access and Content Guidelines for Wundr AI Agents

The Wundr AI Agents feature includes functionality that allows users to create fictional characters based on photos taken with their device’s camera. By enabling camera access, users can upload images to enhance character creation within the App. Please review and adhere to the following guidelines:

Prohibited Content: Wundr AI Agents are strictly designed to generate unique, fictional characters. Users are not permitted to upload photos containing real people or any content that may be deemed harmful, sexually explicit, hateful, or otherwise in violation of copyright laws. Users agree to only upload content that is appropriate and aligns with these standards.

Content Moderation and Copyright Compliance: Wundr AI implements reasonable measures to help ensure that uploaded photos comply with legal standards and do not infringe on any third-party rights. Content moderation is supported by OpenAI’s backend, which applies automated tools to verify adherence to these guidelines and detect potentially inappropriate material

User Responsibility: By using Wundr AI Agents, users agree to these content standards and acknowledge that Wundr AI and its technology partners actively monitor content to promote a safe and compliant environment.

By continuing to use this feature, users consent to these guidelines and understand that any violation may result in removal of the content and/or suspension of account privileges.

5. Data Privacy Commitment

Your privacy is our priority at Wundr AI, Inc. We do not sell, license, or share your data with third parties for their own independent marketing purposes. All data we collect is used strictly to enhance the functionality of the App and to provide a more personalized and engaging experience for our users. For full details on our data handling practices, please refer to our Privacy Policy.

Data Privacy and International Data Transfers

Your privacy matters to us, regardless of where you live. If you are located outside the United States, please note that your personal data may be transferred to and processed in the United States, where our servers are based. U.S. privacy laws may differ from those in your country, but we apply reasonable safeguards to ensure your data is protected throughout this process. By using the App, you consent to these international transfers and understand that we take all appropriate measures to secure your data, ensuring it is handled in accordance with applicable laws and industry standards.

6. Virtual Currency and In-App Purchases

The App includes virtual currency in the form of credits, which may be purchased through in-app purchases on the Apple App Store and Google Play Store. This currency has no real-world value and is strictly limited to use within the App.

Refunds: Virtual currency is non-refundable unless required by applicable law.
Limitations: Virtual currency cannot be transferred, exchanged, or redeemed for cash or other values outside of the App.

7. Subscriptions, Payment, and Refund Policy

Certain features in the Wundr AI App require a paid subscription (“Subscription”) or in-app purchases, available exclusively through the Apple App Store and Google Play Store. By subscribing, you agree to pay any applicable fees as specified in the App, with billing managed directly through the app store where the purchase was made. Subscriptions are billed in advance on a recurring basis (e.g., monthly, annually), based on your selected plan, and automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

Subscription Period and Renewal: By purchasing a Subscription, you agree to pay for recurring access to specific features or content. Your Subscription will automatically renew under the same terms at the end of each billing period unless canceled through your app store account settings.

Subscription and In-App Purchase Providers: Subscriptions and in-app purchases are available through the Apple App Store and Google Play Store. All transactions and billing are managed directly by the respective app store, and your use of these stores is subject to their terms and policies.

Subscription Cancellation: You may cancel a Subscription through your App Store account settings (Apple or Google Play Store). Cancellations take effect at the end of the current billing period, and no refunds are issued for partially used periods unless required by law.

Billing and Fee Changes: Please ensure that your billing information in the app store account is accurate and up-to-date. Wundr AI reserves the right to adjust Subscription fees, with reasonable prior notice provided. Continuing to use your Subscription after a price adjustment confirms your agreement to the updated rate.

Refund Policy: Subscription fees are generally non-refundable, except as required by law. For refunds related to in-app purchases, please refer to the refund policies of the respective app store where the purchase was made and contact them directly if needed.

In-App Purchases: The Wundr AI App may include in-app purchases for additional products, services, or Subscriptions. In-app purchases are consumable within the App only and cannot be redeemed for cash or transferred. If an in-app purchase does not download or function as expected, we will take reasonable steps to repair or replace it. For refund requests or further support, contact the app store directly, as all transactions are governed by their terms.

8. Liability and Disclaimer of Warranties

The App is provided “as is” and “as available.” We disclaim all warranties, whether express or implied, regarding the accuracy, reliability, or fitness for a particular purpose of the App, including AI-generated stories, which are for entertainment and educational use only.

Disclaimer for AI-Generated Content: While Wundr AI strives to provide engaging, high-quality content, users acknowledge that AI-generated stories and images may vary and may not always meet user expectations. Wundr AI does not guarantee the accuracy, creativity, or suitability of AI-generated outputs.

To the extent permitted by law, Wundr AI is not liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, data, or goodwill, arising out of or related to your use or inability to use the App. Our total liability shall not exceed the amount paid by you, if any, in the preceding 12 months.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts located in Delaware, unless otherwise required by applicable law.

For International Users

If you access the App from outside the United States, you do so at your own initiative and are responsible for compliance with any applicable local laws. While these Terms are governed by Delaware law, you may also have certain rights and protections under the laws of your country of residence. To the extent possible, we will respect these local consumer protections. Any claims related to Wundr AI will generally be governed by Delaware law, except where local laws mandate otherwise.

10. Force Majeure

Wundr AI is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, technical failures, or governmental actions.

11. Modifications to These Terms

We may modify or update these Terms at any time. If we make material changes, we will provide notice through the App or via email before the changes take effect. By continuing to use the App after the updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App and may close your account.

12. Termination of License on Account Closure

Upon account closure, whether initiated by you or by Wundr AI, your license to access and use the App terminates immediately. However, Wundr AI retains any marketing and promotional rights to content generated while your account was active, per these Terms.

13. Third-Party Links and Services

The App may contain links to third-party websites or integrate third-party services, such as payment processors and AI platforms, that are not controlled by Wundr AI. We are not responsible for the content, policies, or practices of any third-party websites or services. Use of these third-party services is at your own risk, and you should review their respective terms and privacy policies.

14. Software License

Wundr AI grants you a limited, non-exclusive, non-transferable license to use the App’s software as intended by these Terms. This license does not grant you any rights to the underlying software code or technology. All rights not expressly granted herein are reserved by Wundr AI.
